The present application under Section 439 of the Code of Criminal Procedure has been preferred by the petitioner in connection with Lake Police Station Case No. 314 of 2010 dated 23.12.2010 under Section 120B/302/394/34 of the Indian Penal Code read with Sections 25/27 of the Arms Act. Learned advocate for the petitioner prays for bail on the ground of long incarceration in this case. It is further submitted that due to protraction of the trial, the petitioner is very much entitled to the bail.

Mr. Mukherjee, learned advocate for the State produces a report and submits that the trial is on the verge of the conclusion after the examination of 313 of the Code of Criminal Procedure. We have heard the learned counsel of both sides and perused the report produced by the learned advocate for the State. It appears that only argument is left to be heard which may be taken

up either on the next date fixed or any subsequent date to be suitably fixed by the learned court below. That being the position, we are not in a position to release the accused petitioner on bail at this stage, when particularly, the trial is on the verge of conclusion.

Prayer for bail is considered and rejected.

The application for bail, being CRM No.8500 of 2020, is, thus, dismissed.
