Mr. Dipankar Paramanick For the State The present application under Section 439 of the Code of Criminal Procedure has been preferred by the petitioner in connection with Farakka Police Station Case No. 57 of 2018 dated 22.02.2018 under section 302 of the Indian Penal Code. The learned advocate appearing for the petitioner submits that the petitioner has been falsely implicated in the present case and he is in custody for more than two years and ten months. Out of eight witnesses, only a single witness has been examined and in view thereof, further detention of the petitioner is not necessary.
The learned advocate appearing for the State opposes the prayer for bail.
Having heard the learned advocates appearing for the respective parties and considering the materials in the case diary, the nature of allegations and the gravity of the offence, we are not inclined to grant bail to the petitioner at this stage. Accordingly, the prayer for bail of the petitioner is rejected.
With the aforesaid observations, the application for bail, being CRM No. 8511 of 2020, is dismissed.
