CRR 1530 of 2020 g.b.

22.12.2020 Court No.42 Pradip Kumar Jana Vs.

State of West Bengal & Anr.

Mr. Ayan Bhattacherjee Md. Zohaib Rauf .......For the Petitioner Mr. Madhusudan Sur, Ld. A. P. P.

Mr. Dipankar Paramanick ......For the State Report submitted by Mr. Sur, learned advocate appearing for the State be kept with the record.

The report reflects that further investigation was undertaken and supplementary charge sheet has been filed under Sections 279/338 of the Indian Penal Code. Report also reflects that certain documents were collected in course of further investigation.

In view of the grievance expressed by Mr. Bhattacherjee, learned advocate appearing for the petitioner, I am of the opinion that an opportunity must be given to them to address their grievance. Accordingly, the petitioner is granted liberty to assist the learned Public Prosecutor conducting the trial and express his grievance through the learned Public Prosecutor before the learned trial court. If the learned trial court is of the opinion that further considerations on the materials are required in addition to the contentions raised by the learned Public Prosecutor, the learned trial court would grant liberty to the de facto complainant to file the same through the learned Public

Prosecutor conducting the trial.

With the aforesaid observations CRR 1530 of 2020 is disposed of.
