The grievance of the petitioner is in respect of a letter of complaint which was sent by registered post with A/D to the Officer-in-Charge, Domjur Police Station. A report has been received from the Officer-in-Charge, Domjur Police Station which reflects that the police officer had the occasion to go through the contents thereof as also the General Diary Entries dated 19.09.2020, 20.09.2020 and 25.09.2020. To that effect reference has been made to Domjur Police Station, Howrah Police Commissionerate General Diary Entry No. 708 dated 19.09.2020 and Bankra Out Post General Diary Entry No. 806 dated 25.09.2020.

The said report also reflects that a proceeding under Section 107 of the Code of Criminal Procedure was drawn against some of the private

respondents who have been named in the writ petition being NCR No. 54/2020.

Having considered that the police authorities on enquiry thought it fit and proper to draw proceedings under Section 107 of the Code of Criminal Procedure and the same is a subjectmatter of grievance of the present petitioner, I grant liberty to the petitioner to approach the appropriate jurisdictional court by invoking necessary provisions of the Cr.P.C./BNSS, if he is of the opinion that an investigation is required by a police authority.

With the aforesaid observations, the writ petition being WPA 8978 of 2020 is disposed of. Pending connected application, if any, is consequently disposed of.

There shall be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
