This is an application under Article 226 of the Constitution of India wherein the writ petitioner is aggrieved by non-implementation of an order dated November 28, 2016 passed by the District Inspector of Schools (S.E.), Paschim Medinipur (hereinafter referred to as the 'D.I.').

The petitioner submits that the matter is now lying with the Secretary, School Education Department and the State authority should be directed to decide upon the issue finally.

Mr.
Joytosh Majumdar, learned Government Pleader appearing on behalf of the State also submits that the Secretary, School Education Department should decide this matter after granting an opportunity of hearing to the petitioner.

In light of the submissions made, I direct the Secretary, School Education Department to grant an opportunity of hearing to the petitioner and thereafter, pass a reasoned order within a period of four weeks from the date of communication of this order. The reasoned order should be communicated to the petitioner within a week of passing of the same.

In the event the order is in favour of the petitioner, the respondents authorities are directed to ensure expeditious implementation of the same.

With the above direction, the writ petition is disposed of. There will be no order as to costs. 7.
Since no affidavit-in-opposition is called for, the allegations made in the writ petition are deemed not to have been admitted.
Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
