Vs.

State of West Bengal & Anr.

Mr. Pawan Kumar Gupta Mr. Vijay Verma ... for the petitioner Mr. Ranabir Roy Chowdhury Mr. Mainak Gupta ... for the State The petitioner is aggrieved by the continuance of Chanditala Police Station Case No.462 of 2019 dated 24.10.2019. Learned advocate appearing for the petitioner relies upon certain documents relating to the vehicle which belongs to him and for release of which he had approached this Court. According to him, he is subsequently impleaded in connection with the offence of this particular case. It is specific contention of the petitioner that he is innocent of the charges and the investigating agency perused the materials. There was no specific material against the petitioner for impleading him in connection with the offence. Mr.

Roy Chowdhury, learned advocate appearing for the State submits that the anticipatory bail application of the present petitioner was rejected by a Division Bench of this Court. There are sufficient materials appearing against the present petitioner. Having regard to the issues raised by the petitioner, I am of the opinion that the same are question of facts which are not improbable thereby calling for interference of this Court.

Chanditala Police Station Case no. 462 of 2019. As such the revisional application is dismissed.

The petitioner is, however, granted liberty to rely upon the documents and place the same with the investigating officer of the case for its assessment.

Thus, CRR 1540 of 2020 is disposed of.
