ASR 19.11.2020 (Via Video Conference) In Re : An application for anticipatory bail under Section 438 of the Code of Criminal Procedure, 1973 in connection with Krishnagar Kotwali Police Station Case No. 495/2020 dated 18.7.2020, under sections 447/325/308/34 of the Indian Penal Code.

In Re : NIRMAL BISWAN & ANR ......Petitioner Mr. Prabir Majumder .....for the petitioner Mr. Arijit Ganguly Mr. Sanjib Kumar Dan .....for the State The advocate-on-record for the petitioners undertakes to affirm and properly stamp the petition as per the rules within forty-eight hours of resumption of normal functioning of the Court. The petition is taken up through video conference on the basis of such undertaking.

The alleged offence was committed on 15th July, 2020. Only minor injury was caused by the accused to the victim.

There was no hospitalisation.

The physical injury is out of a family dispute between the accused and the victim.

Considering all these factors we allow this application for anticipatory bail.

Subject to the above, in the event of arrest, the petitioner

will be released on bail upon furnishing security of Rs. 10,000/- (rupees Ten Thousand) together with personal release bond of equivalent value to the satisfaction of the arresting officer. The petitioner will also comply with the conditions laid down in the Section 438(2) of the Code.

CRM 8561 of 2020 is disposed of.
