The petitioner undertakes to appropriately affirm and stamp the petition as per the Rules within one week of resumption of normal functioning of the Court. The petition is taken up through video conference on the basis of such undertaking.

The petitioner states that the petitioner is in custody for about 979 days. It is also submitted on behalf of the petitioner that the petitioner is a deaf and dumb person.

The State has produced the case diary. From the statement of the survivor it appears that a direct allegation has been made by the survivor against the petitioner. The medical report is also in conformity with the statement.

ar/dns In such view of the matter, the petitioner is not entitled to be enlarged on bail. Accordingly, the prayer of the petitioner is rejected. CRM 8565 of 2020 is disposed of.
