It is the grievance of the petitioners that the private respondent no. 6 has encroached a portion of the Highway in Naldi Village, District - North 24-Parganas belonging to the Public Works Department. It is submitted by the petitioners that because such encroachment by construction of illegal shop rooms over the highway, the free ingress and egress of the petitioners to their agricultural land is being obstructed.

For redressal of their grievance, petitioners made a representation before the respondent no. 4 on October 5, 2020, but no effective steps have been taken at his end in spite of that representation.

This writ petition, in view of the facts stated above, is disposed of with a direction upon the relevant highway authority appointed under Section 5 of the West Bengal Highways Act, 1964 to consider the representation dated October 5, 2020, and if the complaint so merits, initiate

appropriate proceedings under Section 10 of the West Bengal Highways Act, 1964 within a period of eight weeks from the date of communication of this order. This writ petition being WPA No. 9064 of 2020 is disposed of.
