Debasis Orow v. State Of West Bengal
04.08.2021 Court No.30 rpan/ 09 CRM 8595 of 2020 In Re:- An application for bail under section 439 of the Code of Criminal Procedure filed in connection with Hanskhali P.S. Case No. 256 of 2017 dated 24.08.2017 under Sections 302/120B of the Indian Penal Code, 1860;
And In re: Debasis Orow - Petitioner Ms. Sonali Das ... for the Petitioner.
Mr. Neguive Ahmed, Md. Anwar Hossain, Ms. Amita Gaur ... for the State.
Prayer for bail is on the ground of long incarceration. Learned advocate for the petitioner submits that five dates already fixed for hearing the argument could not be utilized resulting in protraction of the trial and the petitioner is made to suffer serious prejudice.
Learned advocate for the State submits that the case is at the stage of argument and at this stage, the petitioner should not be released on bail.
Having considered the submissions of both sides and bearing in mind that the case is at the stage of argument, We are not inclined to grant bail to the petitioner. However, we request the trial court to conclude the trial within a period of three months from the date of this order without granting any unnecessary adjournment and also without any justifiable reasons.
The application for bail, being CRM No.8595 of 2020, is, thus, dismissed.
Let the report, as produced by Md. Hoosain, be kept on record.
All parties shall act on the server copies of this order duly downloaded from the official website of this Court. (Subhasis Dasgupta, J.) (Tapabrata Chakraborty, J.)
