The petitioner undertakes to affirm and stamp the petition as per the Rules within one week of resumption of normal functioning of the court. The petition is taken up through video conference on the basis of such undertaking.

The petitioner states that there was a family dispute between the husband of the petitioner on one side and the petitioner and her son. The husband of the petitioner attempted to kill the petitioner and his son with a bonti when the petitioner tried to protect herself and ultimately the husband of the petitioner fell on such bonti and died. The State has produced the case diary. From the post-mortem report it appears that the death was homicidal in nature. The statements recorded under Section 161 of the Code show that the neighbours have deposed that the husband was attacked by the wife and the son and ultimately the husband died.

Considering the gravity of the charge and the material on record, the prayer for bail of the petitioner stands rejected.

CRM 8623 of 2020 stands disposed of.
