This is application seeking a direction for further proceedings and early disposal of Title Suit No. 90 of 2019 pending before the Civil Judge (Junior Division), Kalna. Notice to the respondents is dispensed with preserving their right to seek re-hearing of this matter if they are aggrieved by the directions issued hereby and without prejudice to the contentions as between the parties before the Court below.

Perusing the pleadings in the writ petition and hearing the learned Counsel for the petitioner, it is seen that attempt of the petitioner, who is the defendant in the suit, is to get an early consideration of the suit in which a parcel of land, which is stated to be a courtyard, is the subject matter and there is an order of status quo issued by the Court below. This writ petition is ordered directing that the Court below will consider any request of the writ petitioner for

early consideration of the suit or any application pending at that end. That shall be done in accordance with law. It is clarified that this order does not speak anything touching the merits of the rival contentions of the parties. CO No. 1386 of 2020 is disposed of accordingly. (Thottathil B. Radhakrishnan, CJ.)
