This is an application under Article 226 of the Constitution of India wherein the writ petitioner is aggrieved by the inaction on the part of the respondent authority in giving examination report in relation to that the goods that has been imported for re-export.

Mr. Kaushik Dey, counsel appearing on behalf of the respondent nos.2 and 3, submits that a show cause has been issued in this matter and, therefore, this writ petition has become infructuous.

Accordingly, this writ petition can be disposed of with a direction upon the respondent authorities to act in accordance with law and to provide the petitioner all the documents that they are relying upon in the show cause including the examination report within a period of two weeks from date.

Petitioner is also directed to cooperate with the respondent authority and file their reply to the show cause

notice within the timeframe provided in the show cause notice.

With these observations, WPA 9129 of 2020 is disposed of.

Since, no affidavit-in-opposition has been called for the allegations made in the writ petition are deemed to have not been admitted by the respondents.

There will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
