Bhattacharya, learned advocate, representing the alleged contemnor no. 1 submits that till date the West Bengal Board of Secondary Education has not received the recommendation letter issued by the Commissioner of School Education, West Bengal, dated 6th January, 2023 relating to transfer of the applicant. However, while disposing of the previous contempt application being CPAN 790 of 2023 it was recorded in the order dated 8th September, that the Commissioner of School Education West Bengal, issued recommendation letter dated 6th January, 2023 and copy of the said recommendation letter was taken on record. Since the copy of the recommendation letter dated 6th January, 2023 is available on record the learned advocate representing the alleged contemnor no. 1 is granted leave to obtain photocopy of the said recommendation letter dated 6th January, 2023

which is to be counter-signed by the Court Officer of this Court and the same is to be received by the learned advocate with acknowledgement in course of this day. On receipt of such recommendation letter dated 6th January, the alleged contemnor no. 1 is directed to issue transfer order in favour of the applicant within seven days from date.

List the contempt application under the same heading on 19th January, 2024 for further consideration.

Let the copy of the contempt application be served upon Ms. Bhattacharya. Learned advocate for the applicant is also directed to serve copies of this contempt application upon the non-appearing alleged contemnors by one week after Christmas vacation enclosing copy of the order passed by this Court today and file affidavit of service on the adjourned date.

The memo dated 5th December, 2023 issued by the Deputy Secretary, West Bengal Board of Secondary Education is placed before this Court which is taken on record.
