Mr. Younush Mondal ... ..For the petitioner This is an application under Section 227 of the Constitution which is instituted by the defendants in a suit on immovable property.

Notice to the respondents is dispensed with preserving their rights to seek rehearing of this matter if they are aggrieved by the directions issued hereby and without prejudice to the contentions as between the parties before the court below.

The plaintiffs filed the suit in 2014 and obtained an order of temporary injunction. That order is in force. The complaint of the defendants is that undue delay in final disposal of the suit with such injunction order continuing in force, results in miscarriage of justice. This statement is recorded and the court below is requested to consider any application for expeditious disposal of the suit. Let this be done in accordance with law and after giving an opportunity of hearing to the necessary parties. It is clarified that I have not made any observation touching the merits of the case.

With this observation, the revisional application is disposed of.
