The present application under Section 439 of the Code of Criminal Procedure has been preferred by the petitioners in connection with Krishnagar Kotwali Police Station Case No.419 of 2015 dated 24.06.2015 under Sections 326/ 392/ 397/ 307/ 302/ 34 of the Indian Penal Code.

Mr. Majumder, learned advocate appearing for the petitioners, submits that the petitioners are languishing in custody for more than six years and there is no possibility towards immediate conclusion of the trial.

Records reveal that by an order dated 19th November, 2020, this Court directed the State to file a report as regards the progress in the matter.

Pursuant to such direction, Mr. Sur, learned advocate appearing for the State, has filed a report. Let the same be kept on record.

It appears from the said report that the next date of argument has been fixed on 12th July, 2021. It is, thus, expected

that the trial would be concluded within a reasonable period of time.

In view thereof, we are not inclined to exercise discretion in favour of the petitioners at this stage.

The application for bail, being CRM 8667 of 2020, is dismissed.
