05.11.2020 Court No.16 Item No. 10 rpan CRM 8668 of 2020 (Via Video Conference) In Re: An application for bail under Section 439 of the Code of Criminal Procedure in connection with Habra Police Station Case no.357 of 2018 dated 26.04.2018 under Sections 420/406 of the Indian Penal Code; And In Re: Rajdeep Roy ....Petitioner.

Mr. Ujjal Kumar Roy ... for the petitioner.

Mr. Sudip Ghosh, Mr. Apurba Kumar Dutta ...for the State.

In short, the charge against the petitioner is of swindling funds or being unable to account for rice worth several crores of rupees. The incident is of the year 2016-17. The petitioner says that the business entity with which the petitioner was associated went into insolvency and a resolution professional was appointed at the instance of a creditor bank. The petitioner claims that it is because the relevant business entity went beyond the petitioner's control that the rice could not be accounted for or the money in lieu thereof repaid. The State says that the petitioner has only been tracked down recently and he had given the authorities the slip for a considerable period of time. The State says that there are similar cases pending against this petitioner though advocate for the petitioner points out that the petitioner has been granted bail in some other cases. Considering the gravity of the charges and the apparent involvement of the petitioner in a matter pertaining to substantial quantity of rice remaining unaccounted for, the prayer for bail cannot be

acceded to. Even though the charge-sheet may have been filed upon the investigation being completed, the previous slippery conduct of the petitioner does not inspire confidence.

CRM 8668 of 2020 is dismissed.
