01.07.2021 tkm/ct 30 sl no. 31 CRM 8699 of 2020 (Through video conference) In Re : An application for anticipatory bail under section 438 of the Code of Criminal Procedure in connection with Raghunathpur P.S case no. 68 of 2019 dated 18.5.2019 under sections 363/365/34 of the IPC And In Re : Lata Bauri ...... petitioner Mr. S G Mukherjee, ld PP Mr. N P Agarwala Mr. Ashok Das ..... for the State Records reveal that in an earlier order passed on 25th November 2020, a coordinate Bench of this court observed "since the victim has not yet been traced out, no question arises for granting anticipatory bail to this petitioner". No one appears on behalf of the petitioner though Mr. Agarwala, learned advocate for the State is present with case diary. He submits that the victim girl has not yet been recovered. The principal accused namely Raghunath Bauri and the present petitioner are still absconding.

In view thereof, we are not inclined to exercise any discretion in favour of the petitioner.

Accordingly, application being CRM 8699 of 2020 is dismissed.
