Mrs. Sujata Das ....for the State Having considered the materials on record and keeping in mind the extent of complicity of the petitioners which had transpired from the statement of the co-accused before a police officer, we are inclined to grant bail to the petitioners, however, subject to strict conditions.

Accordingly, we direct that the petitioners shall be released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Chief Judicial Magistrate, Malda, and on further conditions that while on bail they shall remain within the jurisdiction of Mothabari Police Station until further orders and shall report to the investigating officer once in a week until further orders. They shall not intimidate the witnesses or tamper with evidence in any manner

whatsoever and they shall appear before the trial court on every date of hearing and in the event they fail to do so, the trial court shall be at liberty to cancel their bail without further reference to this court.
