....For the State The petitioners claim that they had no role in the suicidal death of the victim.

The State refers to the statement of the mother of the victim to the effect that the first petitioner had lured the victim, who was of an impressionable age, into a relationship only to discard her which resulted in the victim being driven to suicide. The victim was introduced to the first petitioner by the second petitioner, a friend of the first petitioner. Considering the material, the first petitioner should surrender for him to be interrogated in custody. The second petitioner is entitled to obtain anticipatory bail. In the event of arrest, the second petitioner will be enlarged on bail upon furnishing security of Rs.10,000/- (Rupees Ten Thousand only), with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer. The second petitioner should abide by the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973.

The prayer of the second petitioner, Soumik Mondal, is allowed and the prayer of the first petitioner, Mahibur Mondal, is declined.

CRM 8772 of 2020 is disposed of.
