The petitioner claims that the petitioner has been needlessly roped in though nothing was recovered from the person of the petitioner. The petitioner claims that commercial quantity of contraband was recovered from the house of one Rahul Jaiswal and the petitioner was only found to be accidentally loitering outside the house.

The State produces the case records which reveal that the petitioner was in the house with the principal accused at the relevant point of time.

According to the State, the recovery of the commercial quantity of contraband was made jointly from the petitioner and the possession of Rahul Jaiswal.

Considering the quantum of contraband recovered, the petitioner does not qualify to obtain bail.

CRM 8777 of 2020 is disposed of.
