Ms. Zareen Khan Ms. Sujata Das ...for the State In the instant case vide order dated 3rd February, 2020 the learned Additional Sessions Judge, 17th Court, Alipore framed charge under Section 304 of the Indian Penal Code read with Section 185 of the M.V. Act in S.T. No.02(02) of 2020, S.C. 20 (12) of 2019.

In view of such circumstances, the application for bail ought to be filed before the Division Bench having determination.

Under such circumstances, the instant CRM 8790 of 2020 is disposed of as withdrawn with liberty to the learned advocate for the petitioner

to file a fresh application before the Division Bench for hearing.

The petitioner is at liberty to take back the certified copy of the impugned order placing the photostat copy of the same in the record.
