And In the matter of:- Amit Mahato @ Amit Mahanta ... Petitioner Ms. Bushra Khatoon .. for the petitioner Mr. Sanjoy Bardhan, Mr. C.R. Ghosh ..for the State Learned advocate for the petitioner submits that the First Information Report is based on illogical fact and the same prima facie failed to make out any case for custodial detention of the petitioner.

Mr. Bardhan, learned advocate appearing for the State draws the attention of this Court to the First Information Report, seizure list as well as statement of the witnesses.

Learned advocate for the State further submits that investigation of the case is in progress and the chemical examination report is awaiting.

We have taken into account the materials on record, more particularly the seizure list and the complicity of the present

petitioner and on appreciation of the same we are of the opinion that the petitioner has failed to make out any case for extending the privilege of anticipatory bail.

Accordingly, prayer for anticipatory bail is rejected. C.R.M.8806 of 2020 is disposed of.
