The petitioner alleges illegal and unauthorized construction being carried on by the Dulalpur Primary School.

The learned advocate representing the school submits, upon instruction, that the plot of land in which the construction is being made is recorded in the name of the school. There is a plan sanctioned by the Executive Officer of the Panchayat Samity for making construction over the said plot of land.

A copy of the sanctioned plan has been handed over by the learned advocate appearing for the school and the same is retained with the records.

In view of the fact that the school is making construction in accordance with the plan sanctioned by

the Panchayat Samity no order can be passed in favour of the petitioner in the instant writ petition. The Panchayat Samity shall ensure that the construction is being made strictly in accordance with the plan sanctioned.

WPA No. 9219 of 2020 stands disposed of.

Urgent photostat certified copy of this order, if applied for, be given to the parties after completion of all legal formalities.
