The matter pertains to alleged poppy cultivation undertaken by the petitioner herein.

The petitioner claims that the poppy field is actually a water body where no cultivation is possible. However, the State says that the water body was illegally filed up by the petitioner who was in possession thereof and poppy cultivation undertaken thereupon.

Since the poppy found may have already been destroyed, the further detention of the petitioner may not be necessary as long as he reports to the investigating officer as and when called for and once a week till the investigation is completed. Subject to the above, the petitioner will be enlarged on bail upon furnishing security of Rs.10,000/- (Rupees Ten thousand only) with two sureties of like amount each, one of

whom must be local, to the satisfaction of the appropriate Court in Paschim Burdwan.

CRM 8859 of 2020 is disposed of.
