No.11 CRM 8928 of 2020 (Via Video Conference) In Re : An application for bail under Section 439 of the Code of Criminal Procedure in connection with Lake Town Police Station Case No. 236 of 2019 dated 26.12.2019 registered for investigation into offences punishable under sections 325/307/34 of the Indian Penal Code 1860 read with sections 25/27 Arms Act and Sections 3 / 4 of the Explosives Substances Act and adding sections 201/120B/212 of the Indian Penal Code.

And In the matter of : Sonu Roy Chowdhury @ Rohit ..... Petitioner Mr. Anindya Ghosh .... for the Petitioner Mr. Madhusudan Sur, Mr. Dipankar Paramanick. ...for the State. The petitioner undertakes to affirm and stamp the petition as per the Rules within 48 hours of resumption of normal functioning of the court. The petition is taken up through video conference on the basis of such undertaking.

Learned Advocate for the petitioner submits that the petitioner is in custody for more than nine months and the petitioner is similarly placed with the accused persons who have been granted bail in CRM 3832 of 2020 and CRM 3837 of 2020.

Mr. Sur, Learned Advocate for the State draws the attention of this Court to the relevant materials available against the petitioner in the case diary. Learned Advocate for the State also draws the attention of

this Court to the cases which are pending against the present accused/petitioner. To that extent the State also files a Memorandum of Evidence. Let a copy of the same be retained with the record. We have perused the materials on record including the case diary and also the Memorandum of Evidence and on appreciation of the same we are of the opinion that there are number of cases pending against the present accused/petitioner and we are also of the opinion that it would not be safe to release the petitioner on bail at this stage. Accordingly, the prayer for bail is Rejected. With these observations, CRM 8928 of 2020 is disposed of. All parties shall act in terms of copy of this order downloaded from the official website of this Court.

Urgent Xerox certified copy of this order, if applied for, be supplied to the parties, subject to compliance with all requisite formalities.
