The petitioner obtained anticipatory bail against arrest in respect of an offence under Section 363/366A/376/506/34 of the Indian Penal Code and submits that the petitioner could not comply with the direction for surrender made by the Division Bench. Warrant of Arrest, therefore, came to be issued upon the petitioner by the Court below.
Learned Additional Public Prosecutor Mr. Rana Mukherjee submits that this is an opportunity for the Investigating Authorities to secure the presence of the petitioner to assist the investigation. In those circumstances, and based on the submissions of the learned Additional Public Prosecutor, this Court directs stay of the warrant of arrest for a period of one week from date. In the event, the petitioner does not surrender within one week from date, the Court
below shall forthwith issue orders for proclamation and other consequential order to execute the warrant of arrest. In view of the above, the revisional application stands disposed of.
There shall, however, be no order as to costs. Learned Additional Public Prosecutor may communicate the server copy of this order to the Court below. (Rajasekhar Mantha, J.)
