CRR No. 1583 of 2020 Alamgir Molla @ Alamgir Mondal Vs.

Sangita Bibi (Khatoon) & Anr.

The revisionist challenges and seeks stay of an order of proclamation issued by the 4th Court, Alipore for violating an order of payment of maintenance of Rs.3,500/- under Section 125 of the Cr.P.C., to the opposite party/wife. The petitioner approaches this Court nearly after one and half years of the impugned order. This Court is of the opinion that the prayers made in the revisional application are not bona fide as the petitioner could have made payment before the Court below and could have prayed for variation order of attachment.

Since the petitioner has effective remedy in the Court below itself by complying with the order or taking steps in respect thereof before the Sessions Court, no interference is called for in the revisional application.

CRR 1583 of 2020 stands dismissed.

There shall, however, be no order as to costs. (Rajasekhar Mantha, J.)
