The advocate-on-record for the petitioner undertakes to affirm and properly stamp the petition as per the rules within fortyeight hours of resumption of normal functioning of the court. The petition is taken up through video-conference on the basis of such undertaking.
This is a case under Section 498A of the Indian Penal Code. The complaint was made after 12 years of marriage. There is no evidence of any physical injury.
Learned advocate for the petitioner submits that due notice has been given to the State. None appears for the State. We are of the view that custodial interrogation of the petitioner is not required in this case. We allow the application for anticipatory bail of the petitioner.
In the event of arrest, the petitioner will be released on bail upon furnishing security of Rs.10,000/- (Rupees ten thousand only) together with personal release bond of equivalent value to the
satisfaction of the arresting officer.
The petitioner shall also comply with the conditions laid down in section 438(2) of the Code of Criminal Procedure. CRM 8990 of 2020 is, thus, disposed of.
