And In Re : Sanjoy Mondal ...... petitioner Mr. Arka Chakraborty .....for the petitioner Mr. Bitasok Banerjee ....for the State Learned Counsel appearing for the petitioner submits that the petitioner stands on the same footing with the coaccused persons who have been enlarged on bail. In view of the alleged crime and in the light of the facts and circumstances of the case, we are inclined to extend the privilege to the petitioner on parity with the co-accused persons who have been granted bail in CRM 6082 of 2020, CRM 7212 of 2020, CRM 7376 of 2020, CRM 8272 of 2020 and CRM 8281 of 2020.

Accordingly, we direct that the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Chief Judicial Magistrate, North 24-Parganas at Barasat, subject to the conditions that petitioner shall appear before the trial court on every date of

hearing until further orders and shall not intimidate the witnesses and/or tamper with evidence in any manner whatsoever and on further condition that the petitioner, while on bail, shall not enter the jurisdiction of Duttapukur Police Station until further orders except for the purpose of investigation and/or for attending Court proceedings and shall provide the address where he shall presently reside to the Investigating Agency as well as the court below and shall report to the Officer-in-Charge of the concerned police station within whose jurisdiction he shall presently reside once in a week until further orders.

In the event the petitioner fails to appear before the trial court without justifiable cause, the trial court shall be at liberty to cancel his bail automatically without reference to this Court. The application for bail is, accordingly, allowed. (Suvra Ghosh, J.) (Joymalya Bagchi, J.)
