Adhikari Mr. Bipin Ghosh ... for the State Mr. Arit Ali ... for the respondent no.6 This is an application under Article 226 of the Constitution of India wherein the writ petitioner is aggrieved by an alleged purported illegal disconnection by the private respondent.

Counsel on behalf of the C.E.S.C. authorities submits that inspection has been carried and the meter board is in order. According to him, the C.E.S.C. authorities have not carried out any disconnection of the petitioner's electricity line.

The private respondent also fairly submits that in the event there is any disconnection of the line due to some fault, the petitioner shall be at liberty to reconnect the same by using his own electrician.

In light of the above submission, the petitioner is directed to remove the fault in the electricity line with the help of his own electrician. In the event any police assistance is required, the respondent no.5 being the Officer-in-Charge, Parnasree Police Station is directed to provide the same. Cost of such police assistance is to be borne by the petitioner.

I make it clear that I have not gone into the allegations made in the writ petition and the restoration of the electricity line of the petitioner shall not give any equity to the petitioner.

With the above observation, this writ petition is disposed of.

Since no affidavit-in-opposition is called for allegations made in the writ petitioner are deemed not to have been admitted.
