The learned advocate appearing for the State has fairly submitted that the seizure list does not show that any contraband has been recovered from the present petitioner. Considering the materials on record and having regard to the fact that the accused/petitioner has been arrested on the basis of a statement of the co-accused, which is in admissible in evidence, we are inclined to grant bail to the petitioner. Accordingly, we allow this application and direct that the petitioner, namely, Sahidul Mondal @ Saidul, shall be released on bail upon furnishing a bond of Rs.
