Radhya @ Radhya Gupta v. State Of West Bengal

10.11.2020 Item No. 33 CRM 9050 of 2020 Ct. No. 8 SB In Re : An application for bail under Section 439 of the Code of Criminal Procedure in connection with Mathurapur P.S. Case No. 74 of 2017 dated 12.04.2017 under Sections 363/365/370/376 and 419 of the Indian Penal Code.

In the matter of : Radhya @ Radhya Gupta Mr. Dip Jyoti Chakraborty Mr. B. Basak ... for petitioner Mr. Binay Panda Ms. Puspita Saha ... for State Petitioner undertakes to affirm and stamp the petition as per the Rules within 48 hours of resumption of normal functioning of Court. The petition is taken up through video conference on the basis of such undertaking.

Learned advocate appears on behalf of petitioner and submits, bail should be granted on humanitarian ground of his client's father being on deathbed. Mr. Panda, learned advocate appears for State and draws attention to order dated 06.08.2020 passed by a co-ordinate Bench, rejecting last preceding bail application of petitioner. We quote the following from order dated 06.08.2020:- "Having considered the materials on record, prima facie, disclosing involvement of the petitioner in trafficking girls for sexual exploitation and as his prayer for bail was rejected earlier and in view of the gravity of the offence, we are of the opinion that this is not a fit case to grant bail to the petitioner.

The application for bail, being CRM No. 5216 of 2020, is accordingly rejected."

We have not been shown any changed circumstance. The application for bail is rejected.
