CRM 9077 of 2020 (Through Video Conference) In Re: - An application for bail under Section 439 of the Code of Criminal Procedure in connection with Kaliachak P.S. Case No.379 of 2017 dated 11.05.2017 under Sections 489B/489C/12B of the Indian Penal Code.

And In the matter of: Jubraj Sk @ Jubba .... Petitioner Mr. Imdadul Hoque ... For the Petitioner Mr. Sudip Ghosh Mr. Bitasok Banerjee ... For the State The petitioner undertakes to appropriately stamp the petitions as per the Rules within one week of resumption of normal functioning of the court. The petitions are taken up through video conference on the basis of such undertaking.

The primary ground appears to be the delay in the completion of the trial.

The matter pertains to counterfeit currency notes. In the border districts, the malice is as deadly as the present virus going around and has a crippling effect on the local economy. The State says that the trial has been substantially completed and the investigating officer has to take to the stand. Considering the gravity of the charge and the fact that the trial is virtually completed, the prayer for bail is rejected at this stage.

The trial court is requested to ensure that the trial is concluded within six months from date.
