Learned advocate for the petitioner submits that the petitioner was arrested on or about 25.01.2020 and since then he is in custody for about 293 days. He further submits that the case has been committed to the Court of Sessions and the next date is fixed for consideration of the charge. According to the learned advocate of the petitioner that the petitioner is innocent of the charges and he has been falsely implicated in the case.

Learned advocate for the State draws the attention to the FIR, Post Mortem Report as also the TI Parade. We have perused the materials so produced by the State including the Case Diary and prima facie we are of the opinion

that there are materials which heavily goes against the present petitioner.

Having regard to the stage of the case and the materials so appeared, we are of the opinion that the petitioner is not entitled to be released on bail at this stage. Accordingly the prayer for bail of the petitioner is rejected at this stage.

CRM No. 9078 of 2020 is disposed of.
