The petitioner has been in custody in connection with the N.D.P.S. Case No. 87 of 2019 arising out of South Port Police Station/DD Case No. 198 of 2019 dated October 21, 2019 under Section 20(b) (ii) (B)(c) and Section 20 of the N.D.P.S. Act. The case is now pending before the Additional Sessions Judge at Alipore. The petitioner claims that he is in custody for about a year and only seeks expeditious disposal of the said proceeding.

The state is represented through the learned Additional Public Prosecutor Mr. Rana Mukherjee.

In those circumstances, the Court of the 4th Additional Sessions Judge at Alipore or the Court given charge of the responsibility of the said Court shall endeavour to dispose of the trial of the case preferably within a period of one year from the date of

communication of this order. The petitioner shall also be entitled to seek change of Court before the learned District Judge if the 4th Court or the Court in-Charge is not available, who shall consider the same in accordance with law.

The revisional application stands disposed of. There shall, however, be no order as to costs. (Rajasekhar Mantha, J.)
