Subrata Giri v. State Of West Bengal
November 12, 2020 srm/ARDR (Serial No.12) Allowed CRM 9090 of 2020 (Via Video Conference) In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Marishda Police Station Case No. 168 of 2020 dated 25/08/2020 under Sections 498A/ 304B of the Indian Penal Code.
In Re : Subrata Giri, ... petitioner Mr. Arindam Jana, Mr. Bibek Dey, .....for the petitioner Mr. Binoy Kumar Panda, Mrs. Pushpita Saha, ....for the State.
The petitioner claims that the petitioner had no hand in his wife committing suicide.
The State says that there are credible witness statements to the effect that the victim was tortured and tormented upon her failure to get more money from her parents. However, it does not appear that the petitioner herein had any role to play in the death of the victim.
Considering the fact that the petitioner may not have had any role in the unnatural death of the victim, the further custodial detention of the petitioner may not be necessary. However, the petitioner will report to the investigating officer as and when called and, in the event of charges being filed, attend the trial on every date fixed. Any default in such regard, will entitle the trial court to cancel the bail without reference to this Court.
Subject to the above, the petitioner will be enlarged on bail upon furnishing security of Rs.20,000/- (Rupees Twenty thousand only) with two sureties of like amount each, one of whom must be local, to the satisfaction of the appropriate Court in Purba Medinipur.
CRM 9090 of 2020 is disposed of.
