Petitioner Mr. Koustav Bagchi ... for the petitioner Mr. Sanjoy Bardhan Mr. Palash Chandra Majhi ... for the State The petitioner submits that though the petitioner has been arraigned in this case for possession of commercial quantity of codeine mixture but the case has not yet been started as no charge has been framed as yet.

It is submitted on behalf of the learned counsel for the State that FSL report has not yet been received. Bearing in mind the legal impediment under Section 37 of the NDPS Act, the prayer for bail of the petitioner is rejected. However, the learned Special Judge would ensure speedy trial of the case and further see so that the FSL report is collected by the investigating officer at the earliest. CRM 9105 of 2020 is disposed of.
