Roy, Ms. Rita Datta ..for the State Learned advocate for the petitioner submits that the petitioner is in custody since 18.10.2020 and search and seizure so far as the subject matter of the case is concerned is already complete. Learned advocate further submits having regard to the period of detention and the nature of offence, further detention may be unwarranted.

Learned advocate for the State opposes the prayer for bail and draws the attention of the Court to the relevant party of the Case

Diary which includes allegedly offending post for which the present petitioner is in custody.

We have perused the Case Diary and appreciating the materials and having considered the nature of the offence, we are of the opinion that further detention of the petitioner is unwarranted. Accordingly, the prayer for bail of the petitioner is allowed.

The petitioner be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten Thousand only), with two sureties of like amount, one of whom must be local, to the satisfaction of the Learned A.C.J.M, Arambagh and on condition that he shall not tamper with evidence and/or intimidate the witnesses. He shall meet the Investigating Officer as and when called for. With these observations, CRM 9111 of 2020 is disposed of. Learned appropriate Trial Court as well as all concerned authorities shall act in terms of the copy of the order downloaded from the official website of this Court.
