And In the matter of: Utpal Mandal Mr. Partha Ghosh Mr. Sagar Saha ... ... for the petitioner Mr. Rana Mukherjee, APP Ms. Sujata Das ... ... for the State Allegations of assault are serious. Injuries are also grave. However, petitioner does not appear to be the principal assailant.

In view of the extent of complicity of the petitioner in the alleged crime, we are inclined to grant anticipatory bail to the petitioner.

Accordingly, we direct that in the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten Thousand Only), with two sureties of like amount each, to the satisfaction of the arresting officer and also subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This application for anticipatory bail is, thus, allowed.
