ASR 25.11.2020 allowed (Via Video Conference) In Re : An application for bail under Section 439 of the Code of Criminal Procedure, 1973 in connection with Sessions case no. 04(04)2019 corresponding to GR Case pending before the learned Additional Sessions Judge, Ranaghat, Nadia for trial into offences punishable under sections 328/272/273/304/34 of the Indian Penal Code 1860 and 46AA/46B of the Bengal Excise Act 1909, arising out of Santipur Police Station case no. 526 of 2018, dated November 28,2018. ....Petitioners Mr. Sananda Bhattacharjee ......for the petitioner Mr. Madhusdan Sun Mr. Moniranjan Mahato .......for the State The advocate-on-record for the petitioners undertakes to affirm and properly stamp the petition as per the rules within forty-eight hours of resumption of normal functioning of the Court. The petition is taken up through video conference on the basis of such undertaking.

The petitioners are charged with having caused the death of 40 persons by preparation and sale of illicit liquor. Each of them is in custody for a period between 603 and 722 days. Charge-sheet was submitted on 28th September, 2020. Trial has commenced.

It is submitted on behalf of the petitioner that some coaccused have already been released on bail. Learned Advocate for

the State submits that those co-accused are not on the same footing as the petitioners.

In those circumstances, we expedite the trial by directing that it should be concluded by 31st March, 2021 failing which the Court below shall release the petitioners on bail on such terms and conditions as it deem fit and proper. CRM 9181 of 2020 along with CRAN 1 of 2020 is disposed of.
