In the matter of : Rakesh Khan ..... petitioner Mr. Debabrata Das Gupta ....For the petitioner Mr. P. K. Datta, Ld. APP Mr. Santanu Deb Roy .....For the State The principal ground urged is the delay in the trial being taken up and the detention of the petitioner for more than three years.

The State says that on the basis of the statement of the survivor who had received life-threatening blows from the petitioner herein and the that the stolen materials were recovered from the possession of the petitioner, this Court had rejected the prayer in September, 2019.

In view of the pandemic which has the impeded functioning of the court and halted the conduct of any criminal trial, the present prayer cannot be acceded to. However, upon normal court functioning resuming, expeditious steps should be taken to commence the trial again within three months. CRM 9271 of 2020 is disposed of.
