CRM 9289 of 2020 (Through Video Conference) In Re: - An application for bail under Section 439 of the Code of Criminal Procedure in connection with Jagatballavpur P.S. Case No.103 of 2020 dated 09.07.2020 under Sections 302/201/34 of the Indian Penal Code.

For the State The petitioner undertakes to appropriately stamp the petition as per the Rules within one week of resumption of normal functioning of the court. The petition is taken up through video conference on the basis of such undertaking.

The petitioner has been charged with murder.

The State submits that the petitioner was last seen with the victim before the victim went missing. Statements of several persons have been recorded under Sections 161 and 164 of the Code. Such statements indicate that the petitioner was seen assaulting the victim whereafter the victim never returned.

Having considered the postmortem report and the other material in the case diary, we are of the opinion that it is not a fit case where the petitioner should be enlarged on bail immediately. CRM 9289 of 2020 is dismissed.
