W.P.A. 9323 of 2020 + CAN 1 of 2020 (Avijit Banerjee & Others vs. The Union of India & Ors.) Mr. Subir Sanyal Ms. Sumouli Sarkar .... For the Petitioners Mr. Siddhartha Lahiri .... For the Respondent No. 6 The grievance of the petitioners is directed against the failure of the respondent authorities to conduct the elections of the Board of Directors of the Eastern and North Frontier Railway Junior Cooperative Credit Society Limited. It is submitted on behalf of the petitioners that notwithstanding the fact that the tenure of the Board has expired, no fresh elections of the aforesaid Society have been held. Mr. Lahiri, learned advocate appearing for the respondent No. 6 fairly submits that they have no objection if there is a direction for conducting an annual general meeting of the concerned Society.

In view of the submissions made on behalf of the parties, I direct the concerned respondent to conduct elections of the Society within a period of three months in accordance with law after complying with all necessary statutory formalities.

With the aforesaid directions, W.P.A. 9323 of 2020 is disposed of.

Consequently, the application being CAN 1 of 2020 stands disposed of.

There shall be no order as to costs.
