Advocate for the petitioner tries the age-old gimmick. An innocent truck driver unaware of the deceit that is practised all around has apparently been victimised for doing a good turn to a citizen.

The other way of looking at the matter is that the truck driver obtained narcotic goods to ferry the same in his truck in addition to the material that he was carrying. Either way, the law does not make a distinction. Since commercial quantity of narcotic substance was recovered from the possession of the petitioner who was the driver of the concerned vehicle, the petitioner does not qualify to obtain bail. CRM 9327 of 2020 is dismissed.
