It is submitted on behalf of the petitioner that the petitioner is in custody for about 5 years 9 months and there is little possibility of the trial concluding in the near future. Learned lawyer for the State opposes the prayer for bail and submits that the trial has progressed considerably. We have considered the materials on record. However, striking a balance between the period of detention of the petitioner and the gravity of the offence, we are of the opinion further detention of the petitioner may not be necessary and the petitioner may be enlarged on bail subject to strict conditions. Let the petitioner be released on bail upon furnishing a Bond of Rs.
jurisdiction of city of Kolkata until further orders except for the purposes of investigation and/or for attending the court proceedings and shall provide the address where he shall presently reside to the Investigating Agency as well as to the Court below and shall report to the Officer-in-Charge of the concerned police station within whose jurisdiction he shall presently reside once in a week until further orders. In the event the petitioner fails to comply with the conditions as enshrined hereinbefore, it is open to the trial court to cancel the bail without any further reference to this Court.
