02.12.2020 Sdas rejected C.R.M. 9435 of 2020 (via video conferencing) In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with NCB Crime No. 21/NCB/KOL/2018 dated 27.04.2018 and subsequent complaint dated 12.10.2018 for violation of Section 8(c ) of the NDPS Act and offence under Sections 21(C ) of the NDPS Act 21 of the NDPS Act.

Having considered the materials on record disclosing prima facie involvement of the petitioner in the alleged possession of narcotic substance i.e. 460 grams of Heroin which is above commercial quantity and in view of statutory restrictions under Section 37 of the N.D.P.S. Act, we are not inclined to grant bail to the petitioner.

The application for bail is, thus, rejected.

Trial court is directed to expedite the trial and to conclude the same at the earliest without granting any unnecessary adjournment to either of the parties. (Suvra Ghosh, J.) (Joymalya Bagchi, J.)
