Case No. 93/2020 dated 28/04/2020 under Sections 448/341/323/325/326/ 307/506/ 354(A)/34 of the Indian Penal Code read with Sections 3/4 of the Explosive Substance Act.
In the matter of : Selim Reja @ Ors.
..... petitioners Mr. Biswajit Mitra ........for the petitioners Mr. Bidyut Kumar Roy Ms. Rita Dutta ....... for the State Ms. Sonali Das .......For the de-facto complainant The petitioners undertake to affirm and stamp the petition/application as per Rules within one month of resumption of normal functioning of the Court. The petition is taken up for hearing through video conference on the basis of such undertaking.
The learned counsel for the petitioners submits that the petitioners have been falsely implicated. The learned counsel for the State, however, opposes the prayer for anticipatory bail. Considering the materials made available along with the case diary and the prima facie involvement of the petitioners in commission of offence, we are not inclined to grant anticipatory bail to the petitioners. We have relied on the statement recorded under Section 161 of the Criminal Procedure Code which directly implicated the petitioners.
