CONSTITUTIONAL WRIT JURISDICTION WPA No. 9605 of 2020 Gautam Saha -vsCalcutta State Transport Corporation & Ors. Mrs. Susmita Dey (Basu) for the petitioner Mr. Amal Kr. Sen, Mr. Sabyasachi Mondal for the CSTC The petitioner is an employee of the Calcutta State Transport Corporation and he is a cardiology patient. He approached this court on an earlier occasion by filing writ petition being WP No. 12435 (W) of 2019, which was disposed of by an order dated 31st July 2019. In the said order it was recorded that the Medical Board examined the petitioner physically on 24th July 2019 and recommended light work duty for a period of eight weeks. The respondent submits that the petitioner was allotted light duty as per the recommendation of the Medical Board.

The petitioner thereafter presented himself before the Government Hospital where he was advised to avoid physical and mental stress. The petitioner, however, did not report back to the Medical Board.

The opinion of the Medical Board dated 24th December 2019 is that the petitioner should be allotted light duty for three months and a fresh evaluation be

needed after that. It appears that after three months from the date of the opinion of the Medical Board lock down was imposed and the petitioner possibly was not in a position to report back to the Medical Board. Accordingly, the instant writ petition is disposed of by directing the petitioner to report before the Medical Board on the date and time which shall be intimated to the petitioner and his conducting advocate fairly in advance. The authority shall take steps in accordance with the opinion of the Medical Board and the service regulation guiding the petitioner.

WPA 9605 of 2020 is thus disposed of.
