And In Re : Pratima Pandit Petitioner Mr. Arunava Ganguly For the Petitioner Mr. Neguive Ahmed, Ms. Amita Gaur For the State The records of the case reflect that the petitioner was arrested on 17th August, 2015 and since then she is in custody. A report has been submitted by Mr. Ahmed, learned advocate appearing for the State, which is a synopsis, sent by the Inspector-in-charge, Burdwan Police Station dated 18th April, 2021. The report reflects that only four out of eighteen witnesses relied upon in the chargesheet have been examined. Let the report be kept with the record. Having considered the period of detention of the present petitioner and as there is little chance of the trial to be concluded in the near future, we are of the opinion that further detention of the petitioner is not warranted. As such, prayer for bail of the petitioner is allowed.
Accordingly, we direct that the petitioner, namely, Pratima Pandit, shall be released on bail upon furnishing a bond of `10,000/- with two sureties of like amount each, one of whom
must be local, to the satisfaction of the learned Chief Judicial Magistrate, Purba Bardhaman and on condition that the petitioner shall not intimidate the witnesses and/or tamper with evidence in any manner whatsoever and she shall make herself available on each and every date fixed by the trial court. In the event the petitioner fails to appear before the trial court without justifiable cause, the trial court would be at liberty to cancel her bail, in accordance with law, without further reference to this Court.
With the aforesaid observations, the application for bail, being CRM No.9491 of 2020, is, thus, disposed of. All parties shall act on the server copies of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J) (Soumen Sen, J)
